These two types of protection are separate and may apply at the same time. A commercial warranty cannot exclude or reduce your statutory rights under EU consumer protection law.

Important: If you purchased your Zyxel product from a retailer, distributor, ISP, or other professional seller, your statutory legal guarantee claim should normally be addressed to that seller. Zyxel's commercial warranty is a separate protection provided under Zyxel's warranty terms.

1. Statutory Legal Guarantee

Under EU consumer protection rules, goods purchased from a professional seller must conform to the contract. If the product is faulty or does not work as advertised, the seller is responsible for providing a remedy.

Depending on the circumstances, the consumer may be entitled to:

  • free repair or replacement;
  • a price reduction; or
  • a full refund if repair or replacement is not possible or cannot be provided within a reasonable time and without significant inconvenience.

1.1 Who is responsible?

The statutory legal guarantee applies to the purchase contract between you and the seller. It does not automatically create a guarantee claim against the manufacturer.

For example:

You purchase a Zyxel access point from an online retailer. After several months, the device develops a hardware defect.

EU Legal Guarantee: Contact the retailer where you purchased the device.

Zyxel Commercial Warranty: You may also contact Zyxel Support if the product is covered by the applicable Zyxel warranty terms.

The European Commission specifically confirms that the 2-year legal guarantee applies to the contract with the seller, not the manufacturer.

1.2 Duration

Under EU rules, consumers have a minimum 2-year legal guarantee from the date they receive the goods. Individual EU countries may provide additional protection under their national legislation.

1.3 Burden of proof

If a defect becomes apparent within 1 year after delivery, it is generally assumed that the defect existed when the goods were delivered, unless the seller proves otherwise. Some EU countries apply this reversed burden of proof for 2 years.

1.4 Second-hand products

Second-hand goods purchased from a professional seller are also covered by the EU legal guarantee rules.

The standard period is 2 years, but in some EU countries the buyer and seller may agree to a shorter period. It cannot be shorter than 1 year, and this reduced period must be made clear at the time of purchase.

1.5 Products purchased from a private individual

Goods purchased from a private individual are not covered by the EU statutory legal guarantee rules that apply to consumer purchases from professional sellers.

This means that if you purchase a used Zyxel device directly from another private person, the EU statutory legal guarantee does not apply to that purchase.

However, the Zyxel Commercial Warranty is separate from the statutory legal guarantee. If the product is still within its applicable Zyxel warranty period and meets the requirements of the Zyxel Warranty Policy, the product may still be covered by the Zyxel Commercial Warranty.

Example:

2. The Zyxel Commercial Warranty

In addition to the statutory legal guarantee, Zyxel Networks may provide a commercial warranty for its products according to the applicable Zyxel Warranty Policy.

The Zyxel Commercial Warranty is separate from the statutory legal guarantee. It provides additional protection according to the specific warranty terms applicable to your Zyxel product.

The commercial warranty does not replace or reduce your statutory consumer rights.

4. Frequently Asked Questions

Does the 2-year legal guarantee apply even if Zyxel's commercial warranty is shorter?

Yes. The statutory legal guarantee is a legal right against the seller and is separate from the Zyxel Commercial Warranty. A shorter Zyxel commercial warranty does not remove or reduce your statutory rights against the seller.

I bought my Zyxel device second-hand. Am I covered?
